Introduction and Acceptance of Terms

Welcome to Banana2 ("Banana2", "we", "us", "our"), an AI Image & Video Generator that converts prompts and media inputs into high‑quality, commercially usable creative assets. These Terms govern your access to and use of the Banana2 website, application, API, and related services (collectively the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. You generate content using AI models; you must use prompts responsibly.
2. You retain rights to lawful outputs you generate (subject to model / legal limitations) and grant us a license to host & process them.
3. Misuse (abuse, infringements, prohibited content) may result in suspension.
4. Paid plans auto‑renew unless canceled.
5. We provide the Service "as is" without warranty.

Use of the Service

Banana2 enables the submission of prompts and returns generated images, videos, and related metadata. You agree to:

• Use the Service only for lawful purposes.
• Comply with content & safety restrictions (no illegal, violent, hateful, sexual exploitation, personal data abuse, or IP infringement attempts).
• Not probe, scan, or overload infrastructure or attempt to extract model weights / system internals.
• Respect rate limits and fair use boundaries.

User Accounts and Registration

1. Account Creation: Certain features (generation history, API access, billing) require an account. Provide accurate information and update it as needed.
2. Account Security: Maintain the confidentiality of credentials / API keys. Activity under your account is your responsibility.
3. Notification: Inform us promptly of suspected unauthorized access.
4. Age / Eligibility: You represent you are legally permitted to use the Service in your jurisdiction.

Content and Intellectual Property Rights

1. Your Prompts & Outputs: Subject to applicable law and these Terms, you retain rights (including any assignable copyright) in lawful assets you generate. You grant Banana2 a worldwide, non‑exclusive, transferable, sublicensable, royalty‑free license to store, process, cache, display, transmit, and (where you opt in to public galleries / showcases) display them for Service operation, improvement, and feature provision.
2. Third‑Party / Model Constraints: Some outputs may resemble training data styles; we do not guarantee uniqueness or non‑infringement.
3. Our Technology: All platform code, infrastructure, UI, models, and trademarks remain the property of Banana2 or its licensors.
4. Feedback: Suggestions or improvements you provide may be used without obligation or compensation.

Prohibited Activities

You agree not to:

• Generate or attempt to generate disallowed content (illegal activity facilitation, exploitation, hateful or extremist promotion, personal data harvesting, biometric tracking, explicit sexual content involving minors or non‑consenting parties).
• Reverse engineer, decompile, circumvent, or misuse rate limits / usage meters.
• Misrepresent generated content origin (e.g., claiming human authorship where disclosure is legally required).
• Use automated scraping of other users' private content or metadata.
• Upload or prompt with data you lack rights to (confidential, proprietary, personal data without consent).

Content Safety & Prohibited Content

To maintain a safe platform and comply with payment / compliance requirements, the Service strictly prohibits generating, uploading, requesting, or distributing sexually explicit or pornographic content, including NSFW adult sexual content.

This prohibition includes (without limitation): explicit nudity for sexual gratification, graphic sexual acts, sexual exploitation content, and any attempts to bypass safety filters.

Accounts or content that violate this rule may be blocked, removed, suspended, or permanently terminated, and related transactions may be limited or reversed where required by law, payment partners, or platform policy.

Privacy and Data Collection

Data practices are described in our Privacy Policy. By using the Service you consent to processing consistent with that Policy.

Pricing, Plans and Credits

1. Plans & Renewals: Paid subscriptions renew automatically unless canceled before the renewal date.
2. Credits: Generation may consume credits (usage unit). Unused credits may expire as stated at purchase.
3. Billing: You authorize us / our processor to charge the payment method on file.
4. Changes: We may modify plan features or pricing with prior notice where required. Continued use after changes constitutes acceptance.
5. Refunds: Except where required by law, charges are non‑refundable; we may consider goodwill adjustments at our discretion.

Suspension & Termination

We may suspend or terminate access for violations of these Terms, legal risk, suspected fraud, security threats, non‑payment, or abusive usage. You may terminate by ceasing use and (if applicable) canceling any active subscription. Certain clauses (IP, disclaimers, liability limits, governing law) survive termination.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT OUTPUTS WILL BE UNIQUE OR FREE FROM THIRD‑PARTY CLAIMS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANO BANANA AND ITS SUPPLIERS / LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

Indemnification

You agree to defend, indemnify and hold harmless Banana2, its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your misuse of the Service; (b) violation of these Terms; (c) infringement or violation of third‑party rights; or (d) content you generate, submit, or distribute.

Governing Law and Dispute Resolution

These Terms are governed by applicable laws of the jurisdiction in which we operate (without regard to conflict rules). Disputes shall first attempt informal resolution by contacting support. If unresolved, and unless prohibited by law, disputes may be submitted to confidential binding arbitration in a mutually agreed venue. YOU WAIVE CLASS ACTION RIGHTS TO THE EXTENT PERMITTED BY LAW.

Changes to These Terms

We may revise Terms periodically. Material changes (pricing model, IP usage scope) will be notified via email or in‑app notice where practicable. Continued use after effective date constitutes acceptance.
